Scope of Agreement

This agreement is between the Advantage Press, Inc. of Lisle, Illinois and the Community School District of Sample, Texas. The Advantage Press, Inc. has provided the Community School District Board of Education, on June 15, 2008, with Learning Packets on software (as described below) for use in thirteen Junior-Senior High Schools and twenty-seven Elementary Schools, for the purchase price of $11,035.

Materials Provided

The Community School District of Sample, Texas has purchased from Advantage Press, Inc. the following software: High School Detention and Suspension Packets (Versions A & B) (item #s 970 & 971), Junior High School Detention and Suspension Packets (item #s 870 & 871) the High School Supplementary Packets (item #948), and all Elementary Principal and Teacher Packets (item #652).

Site License Terms

The following License Terms govern your use of the above discipline material on CD or in notebook format.

1. License Grant. The Advantage Press, Inc. grants you a license to use, in the above mentioned school system, the Discipline and Motivational Learning Packet Files contained on the enclosed CDs. "Use" includes using, storing, loading, installing, executing, and displaying the Learning Packet Files. You may modify the Learning Packet Files.
   
   
2. Ownership. The Learning Packet Files are owned and copyrighted by The Advantage Press, Inc. Your license confers no title to, or ownership in, the Learning Packet Files and is not a sale of any rights in the Learning Packet Files.
   
   You must reproduce all copyright notices in the original Learning Packet Files and on all copies or adaptations. You may not copy the Learning Packet Files onto any public network.
   
   
3. General Use. You may install and use the Discipline Learning Packet Files described above on any or all of your school district computers, including network server and portable computing devices by adhering to the provisions in numbers five and six below.
   
   
4. Server Use. You may install and use a copy of the Discipline Learning Packet Files as described above on your Internal computer Network for use on computers within your school district. No other network use is permitted, including, but not limited to using the Learning Packet Files either directly or through commands, data or instructions from or to a Computer not part of your internal network, for internet or web hosting services or by any user not licensed to use this copy of the Learning Packet Files through a valid license from The Advantage Press.
   
   
5. Computer Use. Users of the computer on which the Learning Packet Files are stored may also make a second copy for their exclusive use on a portable computer, provided the Learning Packet Files are not being disseminated onto a computer network outside of the purchasing site.
   
   
6. Termination. The Advantage Press, Inc. may terminate your license, upon notice, for failure to comply with any of the above terms. Upon termination, you must immediately destroy the Learning Packet Files, together with all copies, adaptations and merged portions in any form.
